Niniejsze Ogólne warunki („Warunki") zastępują wszystkie wersje wcześniejsze. Do zamówienia stosuje się wersję obowiązującą w dniu jego złożenia; wersja ta jest przekazywana Klientowi pocztą elektroniczną wraz z Kluczem oraz udostępniana w archiwum wersji.
Wyróżnione bloki oznaczone jako „Znaczenie § …" stanowią streszczenie sporządzone językiem uproszczonym. Nie są one wiążące — wiążąca jest treść danego paragrafu.
Wersję angielską otwiera przycisk EN w pasku u góry strony. Językiem umowy jest polski; wersja angielska stanowi tłumaczenie informacyjne, a w razie rozbieżności rozstrzyga wersja polska.
§ 1. Postanowienia wstępne
§ 1.1. Producent
Serwis fractal8.eu oraz opisane w nim programy prowadzi:
- Fractal 8 Dev
- Wrocław, Polska
- Adres poczty elektronicznej: support@fractal8.eu
zwany dalej „Producentem". Podmiot korzystający z serwisu lub nabywający licencję zwany jest dalej „Klientem".
§ 1.2. Zakres przedmiotowy Warunków
Warunki regulują: korzystanie z serwisu fractal8.eu, nabycie licencji na Programy oraz zakres świadczeń Producenta po zawarciu umowy, w tym aktualizacje, wsparcie techniczne i odpowiedzialność za zgodność Programu z umową.
Warunki nie regulują zasad korzystania z samego Programu. Zasady te określa odrębny dokument właściwy dla każdego Programu — Warunki licencji.
§ 1.3. Kategorie Klienta
Podział ten stosuje się w całym dokumencie ze względu na odmienny zakres ochrony przewidziany przepisami dla każdej z kategorii:

Użyte w Warunkach określenie „Konsument" bez dalszego oznaczenia obejmuje obie pierwsze kategorie. Tam, gdzie przepisy je rozróżniają, Warunki wskazują to wprost.
§ 1.4. Definicje
- Program — aplikacja na system macOS wydana przez Producenta i opisana w serwisie.
- Wersja Free — nieodpłatny wariant Programu, udostępniany bez konta i bez ograniczenia czasowego.
- Wersja Pro — odpłatny wariant Programu, udostępniany po aktywacji Klucza.
- Klucz — plik lub ciąg znaków odblokowujący Wersję Pro na liczbie stanowisk wynikającej z nabytego wariantu licencji.
- Sprzedawca — Paddle.com Market Limited, podmiot zawierający z Klientem umowę sprzedaży (§ 3.1).
- Trwały nośnik — sposób przekazania informacji umożliwiający jej zachowanie i odtworzenie w niezmienionej postaci; w relacjach z Producentem — wiadomość poczty elektronicznej wraz z załącznikami.
§ 1.5. Pierwszeństwo dokumentów
Klienta wiążą trzy dokumenty. W razie rozbieżności stosuje się następującą kolejność:
- Warunki licencji danego Programu — mają pierwszeństwo w zakresie korzystania z tego Programu;
- Warunki — w pozostałym zakresie;
- Polityka prywatności — dokument informacyjny; nie nakłada na Klienta obowiązków ani nie ogranicza jego uprawnień.
Żaden z wymienionych dokumentów nie może pozbawić Klienta uprawnień wynikających z bezwzględnie obowiązujących przepisów prawa. Postanowienie sprzeczne z takim przepisem nie obowiązuje w zakresie tej sprzeczności; pozostałe postanowienia pozostają w mocy.
§ 2. Serwis i wymagania techniczne
§ 2.1. Wymagania techniczne
Korzystanie z serwisu wymaga przeglądarki internetowej z obsługą języka JavaScript. Serwis nie wykorzystuje plików cookie ani nie osadza skryptów podmiotów trzecich.
Korzystanie z Programów wymaga komputera Mac oraz wersji systemu macOS wskazanej na karcie danego Programu. Wymagania stanowią element opisu Programu i podlegają sprawdzeniu przed zawarciem umowy.
§ 2.2. Instalacja poza App Store
Programy są udostępniane do pobrania w serwisie Producenta, poza sklepem App Store. Przy pierwszym uruchomieniu system macOS może wymagać potwierdzenia zamiaru otwarcia aplikacji pochodzącej spoza sklepu Apple. Instrukcja postępowania znajduje się na karcie Programu.
§ 2.3. Zakaz dostarczania treści bezprawnych
Zakazane jest dostarczanie treści o charakterze bezprawnym, zakłócanie działania serwisu oraz podejmowanie prób obejścia stosowanych w nim zabezpieczeń. Obowiązek zamieszczenia niniejszego postanowienia wynika z art. 8 ustawy o świadczeniu usług drogą elektroniczną.
§ 2.4. Zagrożenia związane z korzystaniem z usług świadczonych drogą elektroniczną
Z korzystaniem z sieci internet wiąże się ryzyko wprowadzenia do systemu teleinformatycznego oprogramowania złośliwego, nieuprawnionego dostępu do danych oraz podszywania się pod nadawcę wiadomości. Ryzyko to ogranicza utrzymywanie aktualnej wersji systemu operacyjnego, pobieranie Programów wyłącznie z adresu fractal8.eu oraz weryfikacja adresu nadawcy korespondencji. Wiadomość wskazująca jako nadawcę Producenta, wysłana z domeny innej niż fractal8.eu, stanowi podszycie.
§ 3. Zakup i dostarczenie Klucza
Znaczenie § 3
Umowę sprzedaży Klient zawiera z Paddle. Za sam Program — jego działanie, zgodność z opisem, aktualizacje i wsparcie — odpowiada Producent. Reklamacje dotyczące Programu Klient kieruje do Producenta, a sprawy płatnicze do Paddle.
§ 3.1. Sprzedawca
Umowę sprzedaży Klient zawiera ze Sprzedawcą, tj. z Paddle.com Market Limited (30 Old Bailey, Londyn, EC4M 7AU, Wielka Brytania), działającym jako autoryzowany sprzedawca Programów Producenta. W konsekwencji:
- do umowy sprzedaży stosuje się dodatkowo Paddle Buyer Terms oraz Paddle Refund Policy, udostępnione pod adresem
paddle.com/legal; - dokument sprzedaży wystawia Sprzedawca, który rozlicza również podatki właściwe dla kraju Klienta;
- wniosek o zwrot płatności albo oświadczenie o odstąpieniu składa się za pośrednictwem
paddle.net albo przy użyciu odnośnika zamieszczonego w wiadomości potwierdzającej zakup.
Odpowiedzialność za Program ponosi Producent. Reklamacje dotyczące działania Programu, jego zgodności z opisem, aktualizacji oraz wsparcia technicznego Klient kieruje do Producenta na adres support@fractal8.eu; Producent rozpatruje je w trybie § 9.
§ 3.2. Tryb składania zamówienia i zawarcie umowy
Złożenie zamówienia obejmuje następujące czynności:
- wybór wariantu licencji na karcie Programu;
- podanie adresu poczty elektronicznej oraz danych niezbędnych do rozliczenia;
- udzielenie zgody na natychmiastowe dostarczenie treści cyfrowej przez zaznaczenie pola wyboru, które pozostaje domyślnie niezaznaczone (§ 8.3);
- zatwierdzenie zamówienia przyciskiem płatności, z czym wiąże się obowiązek zapłaty.
Umowa zostaje zawarta z chwilą wykonania czynności wskazanej w pkt 4. Do tej chwili Klient może odstąpić od składania zamówienia bez jakichkolwiek skutków.
§ 3.3. Termin dostarczenia Klucza
Klucz jest wysyłany na wskazany adres poczty elektronicznej niezwłocznie po zaksięgowaniu płatności, nie później niż w terminie 24 godzin. Plik instalacyjny jest udostępniany w serwisie niezależnie od Klucza, ponieważ Wersja Free nie wymaga aktywacji.
W razie niedoręczenia Klucza w terminie wskazanym w zdaniu pierwszym Klient zgłasza to na adres support@fractal8.eu. Producent wystawia Klucz ponownie, nieodpłatnie.
§ 3.4. Potwierdzenie na trwałym nośniku
Wraz z Kluczem Producent przekazuje Klientowi, na trwałym nośniku, potwierdzenie zawarcia umowy obejmujące: treść zamówienia, Warunki oraz Warunki licencji w brzmieniu z dnia zawarcia umowy, potwierdzenie zgody udzielonej zgodnie z § 8.3 wraz z informacją o utracie prawa odstąpienia, a także pouczenie o prawie odstąpienia wraz z wzorem formularza odstąpienia.
Skutek braku potwierdzenia
W razie nieprzekazania potwierdzenia prawo odstąpienia nie wygasa, niezależnie od udzielenia zgody i wydania Klucza. Przesłanka czwarta określona w § 8.3 jest konieczna w tym samym stopniu co przesłanki pozostałe.
§ 4. Ceny i płatności
§ 4.1. Ceny
Ceny podane w serwisie są cenami brutto i zawierają należny podatek. Wiążąca jest cena wskazana w kasie przed zatwierdzeniem zamówienia przyciskiem płatności; cena ta zostaje ujęta w potwierdzeniu zawarcia umowy.
Zmiana cen nie wywiera skutku wobec zamówień złożonych przed jej wprowadzeniem.
§ 4.2. Płatność
Metody płatności udostępnia i obsługuje Sprzedawca. Producent nie uzyskuje dostępu do danych instrumentu płatniczego Klienta ani ich nie przechowuje.
§ 4.3. Faktury i podatki
Dokument sprzedaży wystawia Sprzedawca i do niego kieruje się sprawy dotyczące faktur, w tym wnioski o wystawienie faktury na rzecz przedsiębiorcy oraz o ujęcie numeru VAT UE. Sprzedawca rozlicza podatek od wartości dodanej według stawki właściwej dla kraju Klienta, w procedurze unijnej.
§ 5. Licencja
Znaczenie § 5
Nabycie Klucza uprawnia do korzystania z Programu, nie przenosi natomiast praw autorskich. Zakres uprawnień i katalog zakazów określają Warunki licencji danego Programu.
Nabycie Klucza nie przenosi na Klienta autorskich praw majątkowych do Programu. Klient nabywa licencję na korzystanie z Programu — niewyłączną i nieprzenoszalną, na liczbie stanowisk wynikającej z nabytego wariantu.
Zakres licencji, zasady aktywacji, przeniesienia licencji na inne stanowisko oraz katalog zakazów określają Warunki licencji właściwego Programu — dla Programu Master info dokument ten dostępny jest tutaj. Postanowień tych nie powiela się w Warunkach, aby wykluczyć powstanie dwóch rozbieżnych brzmień tej samej regulacji.
§ 5.1. Wersje testowe i przedpremierowe
Wersja Free jest udostępniana bezterminowo i bez konieczności założenia konta i stanowi przewidzianą przez Producenta formę zapoznania się z Programem przed zawarciem umowy. Producent nie prowadzi odrębnych okresów próbnych Wersji Pro.
W razie udostępnienia wersji beta albo przedpremierowej Producent oznacza ją jako taką przy pobraniu oraz wskazuje zakres świadczeń, których w odniesieniu do niej nie zapewnia.
§ 6. Prawa autorskie
Programy, ich kod źródłowy i wynikowy, interfejs, ikony, teksty oraz materiały zamieszczone w serwisie podlegają ochronie prawnoautorskiej i przysługują Producentowi albo są przez niego licencjonowane.
Składniki obcego autorstwa wykorzystane w Programach wskazane są w Warunkach licencji właściwego Programu wraz z licencjami, na jakich zostały udostępnione.
Uprawnienie do zwielokrotniania kodu i tłumaczenia jego formy w celu osiągnięcia współdziałania z innymi programami wynika z art. 75 ust. 2–3 ustawy o prawie autorskim i prawach pokrewnych. Postanowienia dokumentów Producenta nie ograniczają tego uprawnienia.
§ 7. Aktualizacje, wsparcie i koniec wsparcia
§ 7.1. Zakres aktualizacji objętych Kluczem
Klucz uprawnia do korzystania ze wszystkich aktualizacji Programu oznaczonych numerem wersji 1.x, bez opłat dodatkowych i bez świadczeń okresowych. Wersja 2.0, o ile powstanie, stanowić będzie odrębny produkt.
§ 7.2. Aktualizacje wymagane przepisami
Niezależnie od § 7.1 Producent dostarcza aktualizacje niezbędne do zachowania zgodności Programu z umową, w tym poprawki bezpieczeństwa oraz aktualizacje zapewniające zgodność z nowymi wersjami systemu macOS. Obowiązek ten wynika z art. 43j ustawy o prawach konsumenta i nie podlega wyłączeniu postanowieniami Warunków.
Producent informuje o dostępności aktualizacji w Programie. Producent nie ponosi odpowiedzialności za niezgodność wynikającą wyłącznie z niezainstalowania aktualizacji przez Klienta, jeżeli poinformował go o jej dostępności oraz o konsekwencjach jej niezainstalowania.
§ 7.3. Wsparcie techniczne
Wsparcie techniczne świadczone jest za pośrednictwem poczty elektronicznej, na adres support@fractal8.eu, w dni robocze, co do zasady w terminie 2 dni roboczych. Do reklamacji stosuje się termin określony w § 9.4.
§ 7.4. Wycofanie Programu ze sprzedaży
Producent może zakończyć sprzedaż Programu albo jego rozwój. W takim przypadku:
- Klucze wydane przed zakończeniem sprzedaży zachowują ważność;
- Producent informuje o zamiarze zakończenia sprzedaży z wyprzedzeniem nie krótszym niż 90 dni, pocztą elektroniczną na adres wskazany w zamówieniu;
- w okresie wskazanym w pkt 2 Producent dostarcza aktualizacje, o których mowa w § 7.2;
- plik instalacyjny oraz Warunki pozostają dostępne do pobrania przez okres nie krótszy niż 12 miesięcy od zakończenia sprzedaży.
§ 7.5. Zmiana funkcjonalności Programu
Producent może zmieniać, dodawać i usuwać funkcje Programu z ważnej przyczyny, którą stanowi wyłącznie: wymóg bezpieczeństwa, zmiana w systemie macOS, zmiana przepisów prawa albo zakończenie współpracy z dostawcą usługi zewnętrznej, z której dana funkcja korzysta.
Jeżeli zmiana istotnie i negatywnie wpływa na dostęp Klienta do Programu lub na korzystanie z niego, Producent informuje o niej z wyprzedzeniem nie krótszym niż 30 dni, a Klientowi przysługuje prawo wypowiedzenia umowy w terminie 30 dni od dnia dokonania zmiany oraz zwrot ceny w części proporcjonalnej do okresu niewykorzystanego (art. 43q ustawy o prawach konsumenta). Uprawnienie to nie przysługuje, jeżeli Producent zapewni Klientowi dostęp do Programu bez wprowadzonej zmiany i bez kosztów dodatkowych.
§ 8. Prawo odstąpienia od umowy
Znaczenie § 8
Konsumentowi przysługuje 14-dniowe prawo odstąpienia. Przy natychmiastowym dostarczeniu Klucza ustawowe prawo wygasa z chwilą wysłania Klucza, i to wyłącznie po spełnieniu wszystkich czterech przesłanek określonych w § 8.3. Niezależnie od tego Producent zobowiązuje się umownie przyjąć odstąpienie do chwili pierwszej aktywacji Klucza — klucz nieaktywowany podlega zwrotowi. Utrata prawa odstąpienia nie wyłącza uprawnień z tytułu niezgodności Programu z umową (§ 9).
§ 8.1. Podmioty uprawnione
Prawo odstąpienia przysługuje Konsumentowi oraz Przedsiębiorcy na prawach konsumenta (§ 1.3). Przedsiębiorcy prawo odstąpienia nie przysługuje.
§ 8.2. Termin i sposób złożenia oświadczenia
Termin do odstąpienia wynosi 14 dni od dnia zawarcia umowy. Do zachowania terminu wystarczy wysłanie oświadczenia przed jego upływem.
Oświadczenie składa się na adres support@fractal8.eu albo za pośrednictwem paddle.net. Oświadczenie nie wymaga formy szczególnej. Producent potwierdza jego otrzymanie niezwłocznie.
Wzór formularza odstąpienia do pobrania: wersja polska (PDF) · English version (PDF). Posłużenie się wzorem nie jest obowiązkowe.
§ 8.3. Utrata prawa odstąpienia
Klucz stanowi treść cyfrową niedostarczaną na nośniku materialnym. Przy umowie o dostarczanie takiej treści prawo odstąpienia wygasa po spełnieniu łącznie wszystkich czterech przesłanek określonych w art. 38 ust. 1 pkt 13 ustawy o prawach konsumenta:
- Klient wyraził wyraźną i uprzednią zgodę na rozpoczęcie dostarczania przed upływem terminu do odstąpienia;
- Producent poinformował Klienta przed rozpoczęciem dostarczania o utracie prawa odstąpienia;
- Klient przyjął tę informację do wiadomości;
- Producent przekazał Klientowi potwierdzenie zawarcia umowy na trwałym nośniku.
Zgodę, o której mowa w pkt 1, odbiera się w kasie przy użyciu pola wyboru pozostającego domyślnie niezaznaczonym, o następującej treści:
☐ Chcę otrzymać oprogramowanie natychmiast po dokonaniu płatności, przed upływem 14-dniowego terminu na odstąpienie od umowy. Przyjmuję do wiadomości, że po rozpoczęciu dostarczania treści cyfrowej utracę ustawowe prawo odstąpienia od umowy.
Brak zaznaczenia tego pola wyłącza możliwość nabycia Klucza z dostarczeniem natychmiastowym; zamówienie realizowane jest wówczas po upływie terminu do odstąpienia.
Skutki poszczególnych stanów faktycznych:

Dla wygaśnięcia ustawowego prawa odstąpienia miarodajne jest rozpoczęcie dostarczania przez Producenta, tj. wysłanie Klucza, a nie dokonanie jego aktywacji przez Klienta. Niespełnienie choćby jednej z przesłanek wymienionych w pkt 1–4 skutkuje zachowaniem prawa odstąpienia przez pełny okres 14 dni, niezależnie od treści Warunków. Ustęp poniżej wiąże z aktywacją odrębne uprawnienie umowne i zdanie pierwsze go nie ogranicza.
Uprawnienie umowne ponad ustawę. Niezależnie od wygaśnięcia ustawowego prawa odstąpienia Producent zobowiązuje się przyjąć oświadczenie o odstąpieniu złożone w terminie 14 dni od zawarcia umowy, o ile Klucz nie został aktywowany. Odstąpienie jest możliwe tylko i wyłącznie w tym przypadku; pierwsza aktywacja Klucza uprawnienie to wyłącza. Jest to uprawnienie przyznane przez Producenta, korzystniejsze niż wymagają przepisy; nie ogranicza ono żadnych uprawnień wynikających z ustawy, w szczególności określonych w § 9.
§ 8.4. Skutki odstąpienia
Producent zwraca całość otrzymanej płatności w terminie 14 dni od dnia otrzymania oświadczenia, przy użyciu tego samego sposobu zapłaty, którego użył Klient, chyba że Klient wyraźnie zgodził się na inny sposób. Z chwilą skutecznego odstąpienia Klucz traci ważność, a Klient zaprzestaje korzystania z Wersji Pro.
§ 8.5. Zwrot uznaniowy poza reżimem ustawowym
Niniejszy paragraf dotyczy przypadków, w których Klientowi nie przysługuje ani ustawowe prawo odstąpienia, ani uprawnienie umowne określone w § 8.3 — czyli w szczególności sytuacji, w której Klucz został już aktywowany. Zwrotu w takim przypadku Producent może dokonać na zasadzie dobrowolności.
Zwrot taki stanowi uprawnienie przyznane przez Producenta, nie zaś uprawnienie ustawowe. W szczególności:
- decyzja w przedmiocie zwrotu ma charakter uznaniowy; poza przypadkiem określonym w § 8.3 Producent nie zobowiązuje się do dokonania zwrotu w żadnym z góry określonym przypadku ani terminie;
- dokonanie zwrotu w jednym przypadku nie tworzy uprawnienia w przypadkach innych ani nie zmienia treści Warunków;
- odmowa nie wymaga uzasadnienia;
- uprawnienie to nie stanowi gwarancji satysfakcji ani okresu próbnego; formą zapoznania się z Programem przed zawarciem umowy jest Wersja Free.
Wniosek składa się na adres support@fractal8.eu. Zwrotu uznaniowego może dokonać również Sprzedawca, niezależnie od Producenta i na własnych zasadach.
Postanowienia § 8.5 nie ograniczają uprawnień określonych w § 9.
§ 9. Zgodność z umową i reklamacje
Znaczenie § 9
Utrata prawa odstąpienia nie pozbawia Klienta prawa do reklamacji. Jeżeli Program jest niezgodny z umową, Konsument może żądać doprowadzenia go do zgodności, a w dalszej kolejności obniżenia ceny albo odstąpienia od umowy.
§ 9.1. Zakres odpowiedzialności za zgodność z umową
Producent ponosi wobec Konsumenta odpowiedzialność za zgodność Programu z umową na zasadach określonych w rozdziale 5b ustawy o prawach konsumenta (art. 43h i następne). Program jest zgodny z umową, w szczególności gdy odpowiada opisowi, posiada zapowiedziane funkcje, działa na wskazanych wersjach systemu macOS oraz nadaje się do celów, do których programy tego rodzaju są zwykle używane.
Utrata prawa odstąpienia nie pozbawia Klienta uprawnień z tytułu niezgodności Programu z umową. Uprawnienia te nie podlegają wyłączeniu przez udzielenie zgody, o której mowa w § 8.3, ani przez postanowienia Warunków.
§ 9.2. Uprawnienia Klienta
Klient może żądać doprowadzenia Programu do zgodności z umową. Jeżeli Producent odmówi doprowadzenia Programu do zgodności z umową, nie dokona tego w rozsądnym czasie albo byłoby to dla Klienta nadmiernie uciążliwe, a także gdy niezgodność jest istotna, Klient może żądać obniżenia ceny albo odstąpić od umowy i żądać zwrotu zapłaconej ceny.
§ 9.3. Przedsiębiorcy
Wobec Przedsiębiorcy (§ 1.3) odpowiedzialność Producenta z tytułu rękojmi (art. 556 i następne Kodeksu cywilnego) zostaje wyłączona. Wyłączenie nie obejmuje szkody wyrządzonej umyślnie.
§ 9.4. Tryb reklamacyjny
Reklamacje składa się na adres support@fractal8.eu. Zgłoszenie powinno wskazywać przedmiot i datę zakupu, opis niezgodności oraz żądanie Klienta. Wskazanie wersji Programu oraz wersji systemu macOS usprawnia rozpatrzenie zgłoszenia; ich brak nie stanowi podstawy odmowy rozpatrzenia reklamacji.
Producent udziela odpowiedzi na reklamację w terminie 14 dni. Brak odpowiedzi w tym terminie jest równoznaczny z uznaniem reklamacji za zasadną.
§ 10. Odpowiedzialność
§ 10.1. Odpowiedzialność wobec Konsumenta
Wobec Konsumenta Producent ponosi odpowiedzialność na zasadach ogólnych, bez ograniczenia kwotowego.
§ 10.2. Odpowiedzialność wobec Przedsiębiorcy
Wobec Przedsiębiorcy (§ 1.3) odpowiedzialność Producenta ogranicza się do kwoty rzeczywiście zapłaconej z tytułu licencji w okresie 12 miesięcy poprzedzających zdarzenie stanowiące podstawę roszczenia. Producent nie ponosi wówczas odpowiedzialności za szkody pośrednie, utracone korzyści ani utratę danych.
§ 10.3. Wyłączenia bezwzględne
Postanowienia Warunków nie wyłączają ani nie ograniczają odpowiedzialności Producenta za:
- szkodę wyrządzoną umyślnie;
- śmierć albo uszkodzenie ciała spowodowane działaniem lub zaniechaniem Producenta;
- inne przypadki, w których wyłączenie odpowiedzialności jest niedopuszczalne na podstawie przepisów prawa.
§ 10.4. Kopie zapasowe
Funkcje kopii zapasowej udostępnione w Programach mają charakter pomocniczy i nie zastępują własnej strategii tworzenia kopii zapasowych po stronie Klienta. Zaleca się weryfikację możliwości odtworzenia sporządzonych kopii. Operacje skutkujące usunięciem plików Klient wykonuje samodzielnie, po ich zatwierdzeniu.
§ 11. Dane osobowe
Administratorem danych osobowych podanych przy zawarciu umowy oraz przy aktywacji Klucza jest Producent (§ 1.1). Zakres i cele przetwarzania, podstawy prawne oraz okresy przechowywania określa Polityka prywatności.
Czynności, których Producent nie wykonuje
1. Producent nie prowadzi w Programach analityki ani telemetrii i nie gromadzi danych o sposobie ani częstotliwości korzystania z nich. 2. Producent nie zbiera raportów o awariach; funkcja ta pozostaje wyłączona. 3. Producent nie odczytuje, nie przesyła ani nie indeksuje plików Klienta; pomiary wykonywane są na urządzeniu Klienta. 4. Producent nie prowadzi profilowania ani nie udostępnia danych osobowych podmiotom trzecim w celach marketingowych. 5. Programy nie wymagają założenia konta użytkownika. 6. Serwis nie wykorzystuje plików cookie, znaczników śledzących ani skryptów podmiotów trzecich.
Postanowienia niniejszego bloku stanowią część Warunków. Ich zmiana wymaga trybu określonego w § 13.
§ 12. Czas trwania i zakończenie
Licencja obowiązuje bezterminowo w zakresie wersji 1.x Programu. Klient może zakończyć korzystanie z licencji w każdym czasie przez usunięcie Programu.
Producent może zablokować Klucz wyłącznie w następujących przypadkach:
- Klucz został wydany na podstawie płatności, która została cofnięta albo nie doszła do skutku;
- Klucz jest wykorzystywany na większej liczbie stanowisk niż wynikająca z nabytego wariantu, mimo wezwania Producenta;
- Klucz został udostępniony publicznie albo zbyty wbrew Warunkom licencji;
- Klucz służy obejściu mechanizmu aktywacji.
Katalog określony w zdaniu poprzedzającym ma charakter zamknięty. Przed zablokowaniem Klucza Producent wzywa Klienta pocztą elektroniczną do zaprzestania naruszenia i wyznacza termin 14 dni, z wyjątkiem przypadku określonego w pkt 1. Klientowi przysługuje odwołanie składane na adres support@fractal8.eu; Producent rozpatruje je w terminie 14 dni, a w razie uwzględnienia odwołania przywraca ważność Klucza.
Po zakończeniu umowy w mocy pozostają § 6, 9, 10 i 14.
§ 13. Zmiany Warunków
Producent może zmienić Warunki z ważnej przyczyny, którą stanowi wyłącznie:
- zmiana przepisów prawa albo ich wiążącej wykładni;
- rozstrzygnięcie sądu albo organu administracji dotyczące Producenta;
- zmiana sposobu sprzedaży, przyjmowania płatności albo dostarczania Klucza;
- wprowadzenie nowego Programu albo nowego wariantu licencji;
- usunięcie postanowienia niejasnego albo niezgodnego z prawem.
Producent informuje o zmianie z wyprzedzeniem nie krótszym niż 14 dni, pocztą elektroniczną na adres wskazany w zamówieniu, a w razie braku takiego adresu — komunikatem w serwisie oraz w Programie.
Zakaz działania wstecz
Do zamówienia stosuje się Warunki w brzmieniu obowiązującym w dniu jego złożenia. Zmiana Warunków nie wywiera skutku wstecznego i nie dotyczy Kluczy nabytych przed jej wejściem w życie.
Wcześniejsze wersje Warunków pozostają dostępne pod stałym adresem.
§ 14. Spory i prawo właściwe
§ 14.1. Prawo właściwe
Warunki podlegają prawu polskiemu. Konsument mający miejsce zamieszkania w innym państwie członkowskim Unii Europejskiej zachowuje ochronę wynikającą z bezwzględnie obowiązujących przepisów prawa tego państwa; wybór prawa polskiego nie pozbawia go tej ochrony.
Umowa sprzedaży zawarta ze Sprzedawcą podlega prawu wskazanemu w regulaminie Sprzedawcy. Warunki nie zmieniają tej właściwości.
§ 14.2. Właściwość sądu
W sporach z Konsumentem właściwość sądu ustala się według przepisów ogólnych; Konsument może wytoczyć powództwo przed sąd właściwy dla swojego miejsca zamieszkania. W sporach z Przedsiębiorcą właściwy jest sąd właściwy dla siedziby Producenta.
§ 14.3. Pozasądowe rozwiązywanie sporów konsumenckich
Przed wystąpieniem na drogę sądową zaleca się zgłoszenie sprawy na adres support@fractal8.eu.
Konsumentowi przysługuje możliwość skorzystania z pozasądowych sposobów rozpatrywania reklamacji i dochodzenia roszczeń, nieodpłatnie, w szczególności przez wystąpienie do:
- powiatowego (miejskiego) rzecznika konsumentów;
- wojewódzkiego inspektora Inspekcji Handlowej — o wszczęcie postępowania mediacyjnego albo o rozpoznanie sprawy przez stały sąd polubowny;
- Urzędu Ochrony Konkurencji i Konsumentów — w zakresie informacji o instytucjach właściwych, dostępnych pod adresem
uokik.gov.pl; - Europejskiego Centrum Konsumenckiego (
konsument.gov.pl) — w sporach transgranicznych na terenie Unii Europejskiej.
Skorzystanie z wymienionych sposobów jest dobrowolne dla obu stron i nie wyłącza drogi sądowej.
§ 15. Postanowienia końcowe
§ 15.1. Język umowy
Językiem umowy jest język polski. Wersja angielska Warunków stanowi tłumaczenie informacyjne; w razie rozbieżności rozstrzyga wersja polska.
§ 15.2. Rozdzielność postanowień
Nieważność albo bezskuteczność któregokolwiek postanowienia Warunków nie wpływa na ważność postanowień pozostałych. Postanowienie nieważne zastępuje się postanowieniem zgodnym z prawem, najbliższym jego treści i celowi.

Fractal 8 Dev General Terms

These General Terms (the "Terms") replace all earlier versions. An order is governed by the version in force on the day it is placed; that version is sent to the Customer by electronic mail together with the Key and is made available in the version archive.
Highlighted blocks marked "Meaning of § …" are summaries in simplified language. They are not binding — the binding text is that of the paragraph itself.
The Polish version opens with the PL button in the bar at the top of the page. The language of the contract is Polish; the English version is an informative translation and the Polish version prevails in the event of any discrepancy.
§ 1. Introductory provisions
§ 1.1. The Developer
The fractal8.eu website and the programs described on it are operated by:
- Fractal 8 Dev
- Wrocław, Poland
- Electronic mail address: support@fractal8.eu
hereinafter the "Developer". Any party using the website or acquiring a licence is hereinafter the "Customer".
§ 1.2. Scope of the Terms
The Terms govern the use of the fractal8.eu website, the acquisition of licences for the Programs, and the scope of the Developer's obligations after the contract is concluded, including updates, technical support and liability for the Program's conformity with the contract.
The Terms do not govern the use of the Program itself. That is governed by a separate document for each Program — the Licence Terms.
§ 1.3. Categories of Customer
This classification applies throughout the document, the statutory protection afforded to each category being different:

The term "Consumer" used in the Terms without further qualification covers both of the first two categories. Where the applicable provisions distinguish between them, the Terms state so expressly.
§ 1.4. Definitions
- Program — an application for the macOS operating system published by the Developer and described on the website.
- Free tier — the variant of a Program made available free of charge, without an account and without a time limit.
- Pro tier — the paid variant of a Program, made available upon activation of a Key.
- Key — the file or string unlocking the Pro tier on the number of workstations covered by the licence variant acquired.
- Seller — Paddle.com Market Limited, the party concluding the contract of sale with the Customer (§ 3.1).
- Durable medium — a means of providing information enabling it to be retained and reproduced unchanged; in dealings with the Developer, an electronic mail message together with its attachments.
§ 1.5. Order of precedence
Three documents bind the Customer. In the event of discrepancy the following order applies:
- the Licence Terms of the relevant Program — these prevail as regards the use of that Program;
- the Terms — as to all remaining matters;
- the Privacy Policy — an informative document; it imposes no obligations on the Customer and does not limit the Customer's rights.
None of the above documents may deprive the Customer of rights arising from mandatory provisions of law. A provision conflicting with such a rule does not apply to the extent of that conflict; the remaining provisions stay in force.
§ 2. The website and technical requirements
§ 2.1. Technical requirements
Use of the website requires an internet browser with JavaScript enabled. The website uses no cookies and embeds no third-party scripts.
Use of the Programs requires a Mac computer and the version of macOS indicated on the relevant Program's page. Those requirements form part of the Program's description and are to be verified before the contract is concluded.
§ 2.2. Installation outside the App Store
The Programs are made available for download on the Developer's website, outside the App Store. On first launch, macOS may require confirmation of the intention to open an application originating from outside Apple's store. Instructions are provided on the Program's page.
§ 2.3. Prohibition on supplying unlawful content
The supply of unlawful content, the disruption of the website's operation and any attempt to circumvent the safeguards applied to it are prohibited. The obligation to include this provision arises from Article 8 of the Polish Act on Providing Services by Electronic Means.
§ 2.4. Risks associated with services provided by electronic means
The use of the internet carries a risk of malicious software being introduced into an IT system, of unauthorised access to data and of impersonation of the sender of a message. That risk is reduced by maintaining a current version of the operating system, downloading the Programs solely from fractal8.eu and verifying the sender's address. A message identifying the Developer as sender and dispatched from a domain other than fractal8.eu constitutes impersonation.
§ 3. Purchase and delivery of the Key
Meaning of § 3
The Customer concludes the contract of sale with Paddle. The Developer is responsible for the Program itself — its operation, conformity with the description, updates and support. Complaints about the Program go to the Developer; payment matters go to Paddle.
§ 3.1. The Seller
The Customer concludes the contract of sale with the Seller, namely Paddle.com Market Limited (30 Old Bailey, London, EC4M 7AU, United Kingdom), acting as the authorised reseller of the Developer's Programs. Consequently:
- the Paddle Buyer Terms and the Paddle Refund Policy, available at
paddle.com/legal, additionally apply to the contract of sale; - the sales document is issued by the Seller, which also accounts for the taxes applicable in the Customer's country;
- a refund request or a notice of withdrawal is submitted through
paddle.net or using the link contained in the purchase confirmation message.
Responsibility for the Program rests with the Developer. Complaints concerning the operation of the Program, its conformity with the description, its updates and technical support are addressed to the Developer at support@fractal8.eu and are handled under § 9.
§ 3.2. Placing an order and conclusion of the contract
Placing an order comprises the following steps:
- selection of a licence variant on the Program's page;
- provision of an electronic mail address and of the details required for billing;
- granting of consent to the immediate supply of digital content by ticking a checkbox which remains unticked by default (§ 8.3);
- confirmation of the order using the payment button, which entails the obligation to pay.
The contract is concluded upon completion of the step referred to in point 4. Until that moment the Customer may abandon the order without any consequences.
§ 3.3. Time of delivery of the Key
The Key is sent to the electronic mail address provided, without undue delay after the payment clears and no later than within 24 hours. The installation file is made available on the website independently of the Key, the Free tier requiring no activation.
If the Key is not delivered within the period referred to in the first sentence, the Customer reports this to support@fractal8.eu. The Developer reissues the Key free of charge.
§ 3.4. Confirmation on a durable medium
Together with the Key, the Developer provides the Customer, on a durable medium, with confirmation of the contract comprising: the contents of the order, the Terms and the Licence Terms as in force on the date the contract was concluded, confirmation of the consent granted under § 8.3 together with the notice concerning loss of the right of withdrawal, and the withdrawal notice together with the model withdrawal form.
Effect of failure to provide confirmation
Where the confirmation is not provided, the right of withdrawal does not lapse, irrespective of the consent granted and of the issue of the Key. The fourth condition set out in § 8.3 is as necessary as the remaining conditions.
§ 4. Prices and payment
§ 4.1. Prices
Prices stated on the website are gross prices and include the tax due. The binding price is the price displayed at checkout before the order is confirmed using the payment button; that price is set out in the confirmation of the contract.
A change in prices has no effect as regards orders placed before its introduction.
§ 4.2. Payment
Payment methods are made available and handled by the Seller. The Developer obtains no access to, and does not store, the Customer's payment instrument details.
§ 4.3. Invoices and taxation
The sales document is issued by the Seller, to whom invoicing matters are addressed, including requests for an invoice issued to a business and for the inclusion of an EU VAT number. The Seller accounts for value added tax at the rate applicable in the Customer's country, under the EU scheme.
§ 5. Licence
Meaning of § 5
Acquiring a Key confers the right to use the Program; it does not transfer copyright. The scope of that right and the list of prohibitions are set out in the Licence Terms of the relevant Program.
The acquisition of a Key does not transfer to the Customer any economic copyright in the Program. The Customer acquires a licence to use the Program — non-exclusive and non-transferable, on the number of workstations covered by the variant acquired.
The scope of the licence, the rules on activation and on transferring the licence to another workstation, and the list of prohibitions are set out in the Licence Terms of the relevant Program — for the Master info Program, that document is available here. Those provisions are not reproduced in the Terms, so as to preclude two divergent versions of the same rules.
§ 5.1. Test and pre-release versions
The Free tier is made available without a time limit and without the need to create an account and constitutes the means provided by the Developer for examining a Program before the contract is concluded. The Developer operates no separate trial periods for the Pro tier.
Where a beta or pre-release version is made available, the Developer marks it as such at the point of download and indicates the scope of the obligations it does not assume in relation to it.
§ 6. Copyright
The Programs, their source and object code, interface, icons, texts and the materials published on the website are protected by copyright and vest in the Developer or are licensed to it.
Third-party components used in the Programs are identified in the Licence Terms of the relevant Program, together with the licences under which they are made available.
The right to reproduce the code and to translate its form in order to achieve interoperability with other programs arises from Article 75(2)–(3) of the Polish Copyright Act. The provisions of the Developer's documents do not limit that right.
§ 7. Updates, support and end of support
§ 7.1. Scope of updates covered by the Key
The Key confers the right to use all updates of the Program bearing version number 1.x, at no additional charge and without recurring fees. Version 2.0, should it be released, will constitute a separate product.
§ 7.2. Updates required by law
Irrespective of § 7.1, the Developer supplies the updates necessary to keep the Program in conformity with the contract, including security fixes and updates ensuring compatibility with new versions of macOS. That obligation arises from Article 43j of the Polish Consumer Rights Act and is not subject to exclusion by the Terms.
The Developer notifies the availability of updates within the Program. The Developer is not liable for a non-conformity resulting solely from the Customer's failure to install an update, provided the Developer informed the Customer of its availability and of the consequences of not installing it.
§ 7.3. Technical support
Technical support is provided by electronic mail at support@fractal8.eu, on working days and as a rule within 2 working days. Complaints are subject to the period set out in § 9.4.
§ 7.4. Withdrawal of a Program from sale
The Developer may discontinue the sale of a Program or its development. In such a case:
- Keys issued before the discontinuation remain valid;
- the Developer gives notice of the intended discontinuation not less than 90 days in advance, by electronic mail to the address given with the order;
- during the period referred to in point 2 the Developer supplies the updates referred to in § 7.2;
- the installation file and the Terms remain available for download for not less than 12 months following the discontinuation of sales.
§ 7.5. Changes to a Program's functionality
The Developer may change, add and remove functions of a Program for a valid reason, being solely: a security requirement, a change in macOS, a change in the law, or the termination of cooperation with an external provider on which the function relies.
Where a change materially and adversely affects the Customer's access to the Program or its use, the Developer gives notice not less than 30 days in advance, and the Customer is entitled to terminate the contract within 30 days of the change and to a refund of the price in the proportion corresponding to the unused period (Article 43q of the Polish Consumer Rights Act). That entitlement does not arise where the Developer provides the Customer with access to the Program without the change and at no additional cost.
§ 8. Right of withdrawal
Meaning of § 8
A Consumer has a 14-day right of withdrawal. Where the Key is supplied immediately, the statutory right lapses upon dispatch of the Key, and then only once all four conditions set out in § 8.3 are met. Irrespective of that, the Developer undertakes contractually to accept a withdrawal up to the first activation of the Key — an unactivated key can be returned. The lapse of the right of withdrawal does not exclude the remedies for the Program's non-conformity with the contract (§ 9).
§ 8.1. Entitled parties
The right of withdrawal is available to a Consumer and to a sole trader treated as a consumer (§ 1.3). A Business has no right of withdrawal.
§ 8.2. Period and form of the notice
The withdrawal period is 14 days from the day the contract is concluded. Dispatch of the notice before the period expires is sufficient to meet the deadline.
The notice is submitted to support@fractal8.eu or through paddle.net. No particular form is required. The Developer confirms receipt of the notice without undue delay.

§ 8.3. Lapse of the right of withdrawal
A Key constitutes digital content not supplied on a tangible medium. Under a contract for the supply of such content, the right of withdrawal lapses once all four conditions set out in Article 38(1)(13) of the Polish Consumer Rights Act are met cumulatively:
- the Customer has given express and prior consent to supply beginning before the withdrawal period expires;
- the Developer has informed the Customer, before supply began, of the loss of the right of withdrawal;
- the Customer has acknowledged that information;
- the Developer has provided the Customer with confirmation of the contract on a durable medium.
The consent referred to in point 1 is obtained at checkout by means of a checkbox remaining unticked by default and reading as follows:
☐ I want the software delivered immediately after payment, before the 14-day withdrawal period ends. I acknowledge that once supply of the digital content begins I will lose my statutory right of withdrawal.
Failure to tick that box precludes the acquisition of a Key with immediate delivery; the order is then performed after the withdrawal period expires.
Consequences of the individual situations:

What is decisive for the lapse of the statutory right of withdrawal is the commencement of supply by the Developer, that is, the dispatch of the Key, and not its activation by the Customer. Failure to meet even one of the conditions listed in points 1 to 4 results in the right of withdrawal being retained for the full period of 14 days, irrespective of the wording of the Terms. The paragraph below ties activation to a separate contractual entitlement, which the first sentence does not limit.
Contractual entitlement beyond the statute. Irrespective of the lapse of the statutory right of withdrawal, the Developer undertakes to accept a notice of withdrawal given within 14 days of the conclusion of the contract, provided the Key has not been activated. Withdrawal is possible only and exclusively in that case; the first activation of the Key excludes this entitlement. It is an entitlement granted by the Developer, more favourable than the law requires; it limits no rights arising from statute, in particular those set out in § 9.
§ 8.4. Effects of withdrawal
The Developer refunds the whole of the payment received within 14 days of receipt of the notice, using the same means of payment as the Customer used, unless the Customer has expressly agreed to another means. Upon effective withdrawal the Key ceases to be valid and the Customer discontinues use of the Pro tier.
§ 8.5. Discretionary refunds outside the statutory regime
This paragraph concerns cases in which the Customer has neither a statutory right of withdrawal nor the contractual entitlement set out in § 8.3 — that is, in particular, where the Key has already been activated. In such a case the Developer may grant a refund on a voluntary basis.
Such a refund constitutes an entitlement granted by the Developer and not a statutory entitlement. In particular:
- the decision on a refund is discretionary; other than in the case set out in § 8.3, the Developer does not undertake to grant a refund in any predefined case or within any predefined period;
- the grant of a refund in one case creates no entitlement in any other case and does not alter the Terms;
- a refusal requires no statement of reasons;
- this entitlement constitutes neither a satisfaction guarantee nor a trial period; the means of examining a Program before the contract is concluded is the Free tier.
Requests are submitted to support@fractal8.eu. A discretionary refund may also be granted by the Seller, independently of the Developer and on the Seller's own terms.
The provisions of § 8.5 do not limit the rights set out in § 9.
§ 9. Conformity with the contract and complaints
Meaning of § 9
The lapse of the right of withdrawal does not deprive the Customer of the right to complain. Where a Program is not in conformity with the contract, a Consumer may require it to be brought into conformity and, failing that, a price reduction or withdrawal from the contract.
§ 9.1. Scope of liability for conformity
The Developer is liable to a Consumer for the Program's conformity with the contract on the terms set out in Chapter 5b of the Polish Consumer Rights Act (Articles 43h ff.). A Program is in conformity with the contract where, in particular, it corresponds to its description, has the functions announced, operates on the versions of macOS indicated and is fit for the purposes for which programs of that kind are normally used.
The lapse of the right of withdrawal does not deprive the Customer of the remedies for the Program's non-conformity with the contract. Those remedies are not subject to exclusion by the consent referred to in § 8.3 or by the provisions of the Terms.
§ 9.2. The Customer's remedies
The Customer may require the Program to be brought into conformity with the contract. Where the Developer refuses to do so, fails to do so within a reasonable time or doing so would be unduly onerous for the Customer, and also where the non-conformity is material, the Customer may require a reduction of the price or withdraw from the contract and demand a refund of the price paid.
§ 9.3. Businesses
As regards a Business (§ 1.3), the Developer's liability under the statutory warranty (Articles 556 ff. of the Polish Civil Code) is excluded. That exclusion does not cover damage caused intentionally.
§ 9.4. Complaints procedure
Complaints are submitted to support@fractal8.eu. A complaint should identify the subject matter and date of purchase, describe the non-conformity and state the Customer's demand. Indicating the version of the Program and of macOS facilitates handling; their absence does not constitute grounds for refusing to consider a complaint.
The Developer replies to a complaint within 14 days. Failure to reply within that period is equivalent to the complaint being accepted as justified.
§ 10. Liability
§ 10.1. Liability towards a Consumer
As regards a Consumer, the Developer is liable on general principles, without any monetary cap.
§ 10.2. Liability towards a Business
As regards a Business (§ 1.3), the Developer's liability is limited to the amount actually paid in respect of the licence during the 12 months preceding the event giving rise to the claim. The Developer is then not liable for indirect loss, loss of profit or loss of data.
§ 10.3. Absolute exclusions
The provisions of the Terms neither exclude nor limit the Developer's liability for:
- damage caused intentionally;
- death or personal injury caused by the Developer's act or omission;
- any other case in which the exclusion of liability is impermissible under the applicable law.
§ 10.4. Backups
The backup functions made available in the Programs are ancillary and do not replace the Customer's own backup strategy. Verification that the backups created can be restored is recommended. Operations resulting in the deletion of files are performed by the Customer, following confirmation.
§ 11. Personal data
The controller of the personal data provided upon conclusion of the contract and upon activation of a Key is the Developer (§ 1.1). The scope and purposes of processing, the legal bases and the retention periods are set out in the Privacy Policy.
Activities the Developer does not carry out
1. The Developer operates no analytics or telemetry within the Programs and collects no data on the manner or frequency of their use. 2. The Developer collects no crash reports; that function remains disabled. 3. The Developer does not read, transmit or index the Customer's files; measurements are performed on the Customer's device. 4. The Developer carries out no profiling and discloses no personal data to third parties for marketing purposes. 5. The Programs require no user account. 6. The website uses no cookies, tracking pixels or third-party scripts.
The provisions of this block form part of the Terms. Any change to them requires the procedure set out in § 13.
§ 12. Term and termination
The licence runs without a time limit as regards version 1.x of a Program. The Customer may discontinue use of the licence at any time by deleting the Program.
The Developer may block a Key only in the following cases:
- the Key was issued against a payment which was reversed or was not completed;
- the Key is used on a greater number of workstations than the variant acquired covers, despite the Developer's notice;
- the Key has been made publicly available or disposed of contrary to the Licence Terms;
- the Key is used to circumvent the activation mechanism.
The list set out in the preceding sentence is exhaustive. Before blocking a Key the Developer calls upon the Customer by electronic mail to cease the infringement and sets a period of 14 days, save in the case referred to in point 1. The Customer is entitled to appeal to support@fractal8.eu; the Developer considers the appeal within 14 days and, where it is upheld, restores the validity of the Key.
Sections § 6, 9, 10 and 14 survive the termination of the contract.
§ 13. Amendments to the Terms
The Developer may amend the Terms for a valid reason, being solely:
- a change in the law or in its binding interpretation;
- a decision of a court or administrative authority concerning the Developer;
- a change in the manner of sale, of accepting payment or of delivering Keys;
- the introduction of a new Program or a new licence variant;
- the removal of a provision that is unclear or unlawful.
The Developer gives notice of an amendment not less than 14 days in advance, by electronic mail to the address given with the order or, where no such address is held, by a notice on the website and within the Program.
No retroactive effect
An order is governed by the Terms as in force on the day it is placed. An amendment to the Terms has no retroactive effect and does not affect Keys acquired before it enters into force.
Earlier versions of the Terms remain available at a permanent address.
§ 14. Disputes and governing law
§ 14.1. Governing law
The Terms are governed by Polish law. A Consumer resident in another Member State of the European Union retains the protection afforded by the mandatory provisions of the law of that State; the choice of Polish law does not deprive the Consumer of that protection.
The contract of sale concluded with the Seller is governed by the law indicated in the Seller's terms. The Terms do not alter that.
§ 14.2. Jurisdiction
In disputes with a Consumer, jurisdiction is determined under the general rules; a Consumer may bring proceedings before the court of the Consumer's place of residence. In disputes with a Business, the court having jurisdiction over the Developer's seat is competent.
§ 14.3. Out-of-court resolution of consumer disputes
Before bringing proceedings, submission of the matter to support@fractal8.eu is recommended.
A Consumer may make use of out-of-court procedures for handling complaints and pursuing claims, free of charge, in particular by applying to:
- the district (municipal) consumer ombudsman;
- the provincial inspector of the Trade Inspection — for mediation proceedings or for the matter to be heard by a permanent arbitration court;
- the Office of Competition and Consumer Protection — for information on the competent bodies, available at
uokik.gov.pl; - the European Consumer Centre (
konsument.gov.pl) — in cross-border disputes within the European Union.
Recourse to those procedures is voluntary for both parties and does not exclude court proceedings.
§ 15. Final provisions
§ 15.1. Language of the contract
The language of the contract is Polish. The English version of the Terms constitutes an informative translation; the Polish version prevails in the event of any discrepancy.
§ 15.2. Severability
The invalidity or ineffectiveness of any provision of the Terms does not affect the validity of the remaining provisions. An invalid provision is replaced by the lawful provision closest to its content and purpose.
